Hostalot DMCA / Copyright Policy

Effective Date: [12 – 8 – 2025] 

Hostalot respects the intellectual property rights of others and expects our users to do the same. This DMCA / Copyright Policy explains how we respond to claims of copyright infringement on or through our services and how rights holders can submit notices under the U.S. Digital Millennium Copyright Act (“DMCA”).

This policy is incorporated into the Hostalot Terms of Service.


1. Scope

This policy applies to content hosted on infrastructure operated or controlled by Hostalot, including:

  • Websites hosted on Hostalot servers
  • Files and assets stored as part of a hosted site
  • Course or template content hosted by Hostalot

This policy does not apply to content hosted entirely on third-party platforms outside of our control.


2. Copyright Policy

Hostalot’s policy is to:

  • Respond to valid copyright infringement notices under the DMCA.
  • Remove or disable access to allegedly infringing material when appropriate.
  • In appropriate circumstances, terminate accounts of repeat infringers.

Hostalot does not act as an arbiter of disputes between users and rights holders beyond what is required by law.


3. How to Submit a DMCA Takedown Notice

If you believe that content hosted via Hostalot infringes your copyright, you may submit a DMCA notice to our designated agent.

To be effective under the DMCA, your notice must include the following information:

  1. Your contact information
    • Your full name (or name of the authorized representative)
    • Mailing address
    • Telephone number
    • Email address
  2. Identification of the copyrighted work
    • A description of the copyrighted work you claim has been infringed,
    • Or, if multiple works are covered by a single notice, a representative list of such works.
  3. Identification of the infringing material
    • The URL(s) or specific location(s) of the material you claim is infringing on Hostalot’s services,
    • Enough information for us to locate the material (direct links, screenshots, or paths are helpful).
  4. A statement of good faith belief “I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.”
  5. A statement of accuracy and authority “I swear, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or authorized to act on behalf of the copyright owner.”
  6. Your physical or electronic signature
    • Typing your full legal name at the bottom of the notice is acceptable as an electronic signature.

4. Where to Send DMCA Notices

5. What Happens After We Receive a DMCA Notice

Upon receiving a valid DMCA notice, Hostalot may:

  • Remove or disable access to the allegedly infringing material.
  • Notify the account holder or customer responsible for the content.
  • Provide them with a copy of the notice (minus your personal contact info if required by law or policy).

In some cases, we may temporarily disable access while we review the claim, even before making a final determination.


6. Counter-Notification (If You Believe Your Content Was Removed in Error)

If your content has been removed or disabled due to a DMCA notice and you believe this was a mistake or that you have the right to use the material, you may submit a counter-notification.

Your counter-notification must include:

  1. Your contact information
    • Your full name
    • Mailing address
    • Telephone number
    • Email address
  2. Identification of the removed material
    • The URL(s) or specific location(s) where the material appeared before it was removed or disabled.
  3. A statement of good faith belief “I swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.”
  4. Consent to jurisdiction (for users in the United States) “I consent to the jurisdiction of the Federal District Court for the judicial district in which my address is located, or if my address is outside of the United States, I consent to the jurisdiction of the Federal District Court for the [insert appropriate district, e.g., Northern District of Texas]. I will accept service of process from the person who provided the original DMCA notification or an agent of such person.”
  5. Your physical or electronic signature
    • Typing your full legal name at the bottom of the counter-notice is acceptable as an electronic signature.

7. After a Counter-Notification

If we receive a valid counter-notification, Hostalot may:

  • Restore the content within a reasonable time,
  • Unless the original complainant notifies us within the time required by law that they have filed a court action seeking to restrain you from engaging in the allegedly infringing activity.

If legal proceedings are initiated, Hostalot is not responsible for participating in the dispute beyond what is required by law.


8. Repeat Infringers

In appropriate circumstances, and at our discretion, Hostalot may terminate accounts or services associated with users who are determined to be repeat infringers.

We may also limit or suspend services where repeated or egregious copyright violations occur.


9. Misrepresentations

Under the DMCA, anyone who knowingly misrepresents that material is infringing, or that material was removed or disabled by mistake, may be liable for damages (including costs and attorneys’ fees).

You should only submit a DMCA notice or counter-notice if you have a good faith belief in your claim and the legal right to assert it.


10. Changes to This Policy

We may update this DMCA / Copyright Policy from time to time.
We will update the Effective Date and post the revised version.
