Hostalot Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Hostalot’s websites, products, and services, including web hosting, domain-related services, online courses, templates, downloads, and any related tools or support (collectively, the “Services”). By using the Services, you agree to these Terms.

If you do not agree, do not use the Services.


1. Who We Are

2. Eligibility and Account Security

3. The Services

Hostalot may provide:

    • Web hosting and related infrastructure services.

    • Domain-related services through third-party registrars.

    • Digital Products such as online courses, templates, and resources.

    • Technical support based on your plan.

We may update, modify, or discontinue any part of the Services at any time.


4. Acceptable Use Policy (AUP)

You may not use the Services to:

    • Violate any law or regulation.

    • Host or distribute malware, phishing, or harmful code.

    • Attempt unauthorized access to systems, networks, or accounts.

    • Send spam or abuse messaging systems.

    • Infringe intellectual property rights.

    • Host illegal content or content enabling criminal activity.

    • Host content involving exploitation or abuse of minors.

We reserve the right to investigate, restrict, suspend, or terminate Services for violations of this AUP.


5. Fair Use and Resource Limits

Hosting plans are designed for typical website usage. You agree not to:

    • Abuse CPU, memory, disk I/O, or network resources.

    • Run crypto mining, distributed computing, or similar high-load tasks.

    • Use hosting primarily as a file repository, backup vault, or media dump.

If your use materially impacts platform performance or stability, we may:

    • Require an upgrade,

    • Apply usage limits,

    • Or suspend affected services.


6. Your Content

You retain ownership of your Content.
You grant Hostalot a limited license to host, store, and process your Content solely to provide the Services.

You are responsible for:

    • The legality of your Content.

    • The accuracy and safety of anything you publish.

    • Maintaining independent backups unless your plan explicitly includes robust backup coverage.


7. Backups

Hostalot may provide automated backups on certain plans as a convenience.
However:

    • Backups are not guaranteed.

    • Restores may not be available for every event or timeframe.

You are ultimately responsible for maintaining your own independent backups of critical data.


8. Uptime and Maintenance

We aim to provide reliable service but do not guarantee uninterrupted availability.
Scheduled maintenance or emergency actions may occur to protect security or stability.

If Hostalot provides an uptime commitment for a specific plan, it will be stated in a separate SLA or plan description.


9. Domains and Third-Party Services

Domain services may be provided through third-party registrars.
Your domain registrations, renewals, and transfers may also be subject to their terms and policies.

Hostalot is not responsible for:

    • Registrar policy changes,

    • Registry pricing changes,

    • Third-party outages or failures.


10. Fees, Billing, and Taxes

You agree to pay all fees associated with your Services.

Key points:

    • Fees are generally billed in advance.

    • You authorize Hostalot and its payment processors to charge your payment method on file.

    • Taxes may apply based on product type and jurisdiction.

    • Failure to pay may result in suspension or termination of Services.


11. Renewals

Services may auto-renew unless you cancel through your account prior to the renewal date.
You are responsible for maintaining valid payment details and monitoring renewal dates.


12. Refund Policy

Refund rules vary by product type:

12.1 Hosting

If a money-back guarantee is offered for your plan, it applies only as stated at checkout or in the plan description.

Unless otherwise stated:

    • Setup fees, migrations, custom work, and add-ons may be non-refundable.

    • Abuse, policy violations, or chargeback-related suspensions may void refund eligibility.

12.2 Domains

Domain registrations, renewals, transfers, and related fees are generally non-refundable due to third-party registrar and registry rules.

12.3 Digital Products (Courses/Templates)

Due to immediate digital access, Digital Products are non-refundable once access is granted or content is delivered, except where required by law or explicitly stated otherwise.


13. Digital Product Access Tied to Purchases

Some course or members-only content may be unlocked based on verified purchases through our billing systems (including systems integrated with third-party platforms).

You acknowledge:

    • Access is granted based on successful payment and account verification.

    • We may revoke access if a payment is reversed, disputed, fraudulent, or refunded.


14. Intellectual Property

Hostalot retains all rights in:

    • Our brand, logos, site design, platform assets, and proprietary materials.

    • Our Digital Products, course content, and templates, unless otherwise stated in writing.

You may not copy, resell, distribute, or create derivative commercial products from Hostalot materials except as permitted under these Terms.


15. Template and Course License

Unless otherwise stated, Hostalot grants you a limited, non-exclusive, non-transferable license to use templates and course materials for:

    • Personal use, and

    • Commercial use only for your own business projects and your own websites.

You may not:

    • Resell or redistribute templates as standalone products.

    • Upload Hostalot templates into public template libraries/marketplaces.

    • Claim Hostalot templates as your original product for resale or licensing.

Hostalot may offer expanded licenses (e.g., agency or client-use licensing) separately.


16. Security and Abuse Response

We may take immediate action, including suspension, to address:

    • Security threats

    • Malware distribution

    • Active exploitation

    • Severe AUP violations

We may cooperate with law enforcement where legally required.


17. Suspension and Termination

We may suspend or terminate your access if:

    • You violate these Terms or the AUP.

    • You fail to pay when due.

    • Your activity creates security, legal, or operational risk.

You may cancel at any time through your account.
Upon termination:

    • We may delete your data after a reasonable period unless legally required to retain it.


18. Disclaimer of Warranties

The Services are provided “as is” and “as available.”
To the fullest extent permitted by law, Hostalot disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.


19. Limitation of Liability

To the fullest extent permitted by law, Hostalot will not be liable for indirect, incidental, special, consequential, or punitive damages.

Hostalot’s total liability for any claim related to the Services will not exceed the amount you paid to Hostalot for the affected Services in the three (3) months immediately preceding the event giving rise to the claim.


20. Indemnification

You agree to indemnify and hold harmless Hostalot from claims, losses, or damages arising out of:

    • Your Content

    • Your use of the Services

    • Your violation of law or third-party rights


21. Changes to These Terms

We may update these Terms from time to time.
We will update the Effective Date and provide notice as required by law.

Your continued use of the Services after changes constitutes acceptance of the updated Terms.


22. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
